Goat Yard Marine, LLC — Storage and Service Contract
Payment is due when invoiced. A 1-1/2% monthly (18% annually) service charge will be added to all invoices 30 days past due.
- This Agreement is for boat storage and service and will serve as notice of the Michigan Marina and Boatyard Storage Lien Act (PA 362 of 1998) should filing of a lien become necessary.
- The current Goat Yard Service and Storage Rates apply to this Agreement.
- The total storage contract payment is due at the time of haul-out, unless other arrangements are made with authorized Goat Yard representatives. Any unpaid balance will be assessed a service charge at the rate of 1-1/2% per month on any outstanding account balance.
- Storage is at the sole risk of the boat Owner. Goat Yard Marine, LLC (GY) is not responsible for damage, loss, or theft of any kind to boat, gear, or equipment. Sails stored are not covered for damage resulting from insects, birds, rodents and other animals. GY does not carry fire or any other insurance for stored boats, trailers, cradles, equipment, or related items. GY strongly recommends the boat Owner carries their own insurance. GY strongly recommends that the Owner not leave personal items on the boat in storage. GY assumes no responsibility for personal property or electronics left on the boat during storage.
- No boat may be plugged into electricity overnight. Cords left out overnight may be confiscated.
- Owner is responsible for the care and maintenance of their cradle or trailer. GY has the right to deem a cradle or trailer unfit for use if necessary.
- All boat Owners and their agents must contact GY representatives for entry onto GY property with advance notice.
- Boat Owners agree GY shall not be responsible, nor liable, for any damage resulting from the freezing or ice conditions during the time of storage. Winterization of all systems is the responsibility of the boat Owner.
- Cooperation in keeping the yard clean is appreciated. Boat Owners will be charged for cleanup caused by themselves or their agents.
- Boat Owner performed work on GY property requires proper and adequate insurance coverage, proof of which shall be presented upon entry onto the property. GY reserves the right to deny access to outside contractors at GY discretion. The boat Owner and their agents waive and hold harmless GY for any and all liability.
- The boat Owner understands and agrees that GY assumes no responsibility and shall not be liable for any injury to any persons while on GY property. Boat Owners agree to indemnify and hold harmless GY from any and all losses, damages, liabilities, and expenses arising from any acts, omissions, neglect or fault of the boat Owner and their agents.
- No advertising, soliciting or for sale signs shall be permitted on any boat on GY property.
